I. General conditions:

Definitions of language used in the text

Booking Form - a document in an electronic version, being the only means by which a booking for an accommodation can be made by means of the Owner

Flat and cottage - the flat described in detail on the website www.cracowforrent.com.pl, the cottage described in detail on the website www.cottageinpoland.com,  which are the subjects of booking.

Preliminary confirmation of booking - form of accepting the Client’s request containing the number of the booking request, the reservation fee, the price for the service and the number of the bank account on which the reservation fee should be sent

Booking Fee - the fee which is 30% of the price for service. It is a payment on account for the service
Final Confirmation of Booking – the form of accepting the booking fee

Owner – Monika Urbañska, 17Es 22 Kadrowa St., 04-421 Warsaw, managing the internet service www.cottageinpoland.com and www.cracowforrent.com.pl, which makes reservations and providing the service

Booking/Reservation - the right to use the flat according to the conditions defined in the final confirmation of booking and the conditions specified in this text

Customer/Client - a person or a company having the ability to form a legal contract

Service - services of renting the accommodation described on the website www.cottageinpoland.com and www.cracowforrent.com.pl, which are rented to the Customer by the Owner, who acts in her own name.

II. Booking/Reservation

1. To make a reservation, the Customer fills in and sends the reservation form on the following e-mail address:reservation@cracowforrent.com.pl
2. The Owner sends the preliminary confirmation of booking to confirm making a reservation
3. The reservation is valid from the moment the reservation fee is transferred to the Owner’s bank account
4. The Owner sends the Final Confirmation of Booking on the e-mail address given by the Client within 48 hours from the date of the transfer of the booking fee to the Owner's bank account
5. The Final Confirmation of Booking and the Booking Form constitute a Rent Agreement which is valid if the Price for the Service is paid and on the principles described in this text.

III. Terms of Payment

1. The Client makes a payment - on the bank account given in the Preliminary Confirmation of Booking no later than three days from the day of receiving the Preliminary Confirmation of Booking or two days before using the flat.
2. If the payment is booked according to the terms specified above , the booking will not be valid unless the Operator makes the Final Confirmation of Booking in spite of this.
3. The Payment for the remaining part of the price for the service is made according to the following principles:
1. in cash while getting the keys to the flat or
2. by money transfer to the Owner's bank account together with the payment of the booking fee
4. The payments for additional services not included in the reservation are made in cash or by money transfer while ordering the services.
5. The costs of money transfers are covered by the Client
6. In each case the payment of the whole price for the stay and the transfer of the money to the Owner's bank account must be made before giving the rented flat or cottage to the Client

IV. Cancelling the booking

1. In the case of cancellation of the booking, the Client fills in e-mail with cancelation notice.
   
2. The Operator has the right to collect from the Client the following payments:

• 30% of the booking fee, if the cancellation of the booking takes place not later than 21 days before the first day, on which the Client is going to use the flat or cottage. 
• 50% of the booking fee if the cancellation takes place later than stipulated in point '2' In the case of cancellation of the booking, the amount of money is transferred to the bank account given by the Client in written form or to the bank account, from which the booking fee was paid.
• 100% of the booking fee if the cancellation takes place later than 14 days before the first day, on which the Client is going to use the flat or cottage. 

V. Liability

1. In the case of extreme circumstances independent of both parties, natural disasters, strikes, war actions or other extreme situations making provision of the service impossible, the Owner is exempt from liability.
2. The Owner is not liable for any problems with access to the booking system resulting from reasons independent of the Owner. The Owner can block access to the service www.cottageinpoland.com or www.cracowforrent.com.pl for a period necessary for removing technical and organisational obstacles.

VI. The terms (conditions) of renting the flat

The Client using the service is obliged to observe the following principles:

1. Collecting the keys takes place at the place and according to the terms specified in the booking confirmation
2. While collecting the keys, the Client shows the ID card
3. The Client gives the keys back on the last day of his stay until 12 a.m. at the place and according to the terms specified in the booking confirmation
4. The Client is obliged to inform the Owner about all the events, which can cause damage the owner of the flat
5. The Client is obliged to properly use water and electrical appliances. For preventing fires, the Client must not use any electrical appliances which are not part of the equipment of the flat with the exception of computers, shavers and hair dryers
6. The Client can use the flat as accommodation and he must not rent it to anyone without the owner's consent
7. additional services can be ordered on the conditions specified in the internet service www.cottageinpoland.com and www.cracowforrent.com.pl or by e-mail reservation@cottageinpoland.com
8. The Client is liable for any damage caused to the equipment or the flat or cottage itself. The Client is obliged to inform the Owner about any such damage and to cover the cost of the damage before the last day of the stay in the flat or cottage.

VII. Personal information.

Making a reservation on the website www.cottageinpoland.com and www.cracowforrent.com.pl the Client agrees to have his personal information put in the database of the Owner responsible for the process of booking. All the information will be processed only in order to make a reservation and for marketing purposes according to the statute referring to the protection of personal data (29th August, 1997). The Client has the right to see this data and correct it.
